1. Acceptance of Terms

Your agreement to these terms

My Legacy Console is owned and operated by Montauk Trading Company, LLC, a Delaware limited liability company authorized to do business in New York ("Company," "we," "us," or "our"). By creating an account, accessing, or using My Legacy Console (the "Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not access or use the Service. We reserve the right to modify these Terms at any time. Material changes will be communicated to you at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

2. Description of Service

What My Legacy Console provides

My Legacy Console is your secure, web-based daily command center for generational wealth — a privacy-first financial management platform built for the $124 trillion Great Wealth Transfer from Baby Boomers to Gen X, Millennials, and Gen Z. It accesses only your cloud drives, never stores your data, and is built so anyone in the family can pick it up the moment it matters most — with scoped multigenerational access — across the entire wealth spectrum. The platform provides tools for:

• Financial Dashboard: Consolidated view of assets, liabilities, net worth, and portfolio analytics
• Budget Management: Monthly income and expense tracking with annual forecasting
• Investment Analysis: Stock portfolio tracking, performance analysis, and market data
• Document Management: Linking and organizing financial, legal, and personal documents via Microsoft OneDrive
• Estate Planning: Legal document organization, trust management, and wealth transfer planning
• Insurance Management: Policy tracking, coverage analysis, and document storage
• AI Assistants: Contextual AI-powered assistance for financial analysis and document processing
• Bill Pay & Subscriptions: Bill tracking, payment scheduling, and subscription management

3. Account Registration

Requirements and responsibilities

Eligibility

• You must be at least 18 years old to use the Service
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You must promptly notify us of any unauthorized access to your account

Organization Accounts

The person who creates an organization is designated as the Owner. Owners can invite additional members with Admin or Member roles. Each role has different permissions as defined in the application. The Owner is responsible for the activities of all organization members.

4. Subscription Plans & Billing

Pricing, payments, and cancellations

Billing Terms

• Payment Processing: All payments are processed securely by Stripe. We do not store your payment card details.
• Billing Cycle: Subscriptions are billed monthly on the anniversary of your subscription start date.
• Upgrades: When upgrading, you will be charged the prorated difference for the remainder of your billing cycle.
• Downgrades: Downgrades take effect at the end of the current billing cycle. No prorated refunds are issued.
• Failed Payments: If a payment fails, we will attempt to charge your payment method up to 3 times over 7 days. If all attempts fail, your subscription will be downgraded to the Free tier.

Cancellation & Refunds

• You may cancel your subscription at any time through the Settings page
• Cancellations take effect at the end of the current billing period — you retain access until then
• Refunds are available within 14 days of initial subscription or upgrade, provided the Service has not been extensively used
• After the 14-day period, no refunds will be issued for partial billing periods

Advertising & Sponsored Content (Free Tier)

• Ad-Supported Free Tier: The Free plan ($0/mo) is provided at no cost. To help sustain the platform, the Free tier may at any time include advertisements, sponsored content, or promotional placements within the application interface. These may appear as banner ads, sponsored cards, or inline promotions.
• No Ads on Paid Plans: Standard ($9.95/mo) and Pro ($99.95/mo) subscribers will never see advertisements or sponsored content. Upgrading to a paid plan permanently removes all advertising from your experience.
• Ad Content Standards: All advertisements will be clearly labeled as sponsored content. We will not display ads that are misleading, predatory, or inappropriate. Ads will be relevant to personal finance, estate planning, and wealth management where possible.
• Your Data & Ads: We will never sell, share, or provide your personal financial data to advertisers. Advertisements are not targeted based on your financial information, account balances, holdings, or transaction history. Your data privacy is fully preserved regardless of ad display.
• Right to Modify: We reserve the right to introduce, modify, or remove advertising from the Free tier at any time without prior notice. The introduction of ads does not alter any other terms of this Agreement.

5. Acceptable Use Policy

What you can and cannot do

Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service, other user accounts, or connected systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated scripts, bots, or scrapers to access the Service without authorization
• Upload malicious code, viruses, or harmful content
• Impersonate another person or entity
• Use the Service to process data for third parties without their knowledge or consent
• Resell, sublicense, or redistribute the Service without written authorization
• Interfere with or disrupt the integrity or performance of the Service
• Use the AI features to generate content that is harmful, deceptive, or violates any laws

6. Intellectual Property

Ownership and licenses

Our Property: The Service, including its design, code, features, documentation, logos, and trademarks, is owned by Montauk Trading Company, LLC and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand features without prior written consent.

Your License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes.

Feedback: If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free license to use, modify, and incorporate that feedback into the Service without obligation to you.

7. User Content & Data

Your data, your ownership

Ownership: You retain all ownership rights to the data, documents, and content you input into or link through the Service ("User Content"). We do not claim ownership of your User Content.

License to Us: You grant us a limited license to process, store (in encrypted form), and display your User Content solely for the purpose of providing and improving the Service.

Document Storage: Documents are linked from your Microsoft OneDrive account and are never permanently uploaded to or stored on our servers. Only metadata and reference links are stored in our database. You maintain full control of your documents in OneDrive.

Data Portability: You may export your data at any time. Upon account deletion, we will permanently remove your data within 30 days, except where retention is required by law.

Your Data, Your Control

We believe your financial data belongs to you. You can export, transfer, or delete your data at any time. We encrypt sensitive fields with AES-256-GCM and never sell your data to third parties.

8. Third-Party Services

Integrations and external services

The Service integrates with third-party services including Stripe, Plaid, Microsoft OneDrive, Microsoft Outlook, Polygon.io, OpenRouter, xAI, and Twilio. Your use of these integrations is subject to the respective terms and privacy policies of each provider.

We are not responsible for the availability, accuracy, or performance of third-party services. If a third-party service becomes unavailable, the features of our Service that depend on it may be temporarily limited.

You authorize us to send and receive data on your behalf through these integrations as necessary to provide the Service functionality you have requested.

My Legacy Console is a management tool, not an advisory service. The Service does not provide financial advice, investment recommendations, tax guidance, or legal counsel. AI-generated insights are for informational purposes only. Always consult with qualified professionals before making financial, legal, or tax decisions.

AS-IS BASIS: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

NO GUARANTEE: We do not guarantee that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy of market data, stock prices, or any financial information provided through the Service.

AI LIMITATIONS: AI-generated content may contain errors, inaccuracies, or outdated information. You should independently verify any AI-generated insights before making decisions based on them.

10. Limitation of Liability

Maximum exposure

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONTAUK TRADING COMPANY, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Errors in financial calculations, AI-generated insights, or third-party data
• Unauthorized access to or alteration of your data (beyond our reasonable control)
• Service interruptions or downtime

MAXIMUM LIABILITY: Our total aggregate liability for any claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.

11. Indemnification

Your responsibility to us

You agree to indemnify, defend, and hold harmless Montauk Trading Company, LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of a third party
• Any content you submit through the Service

12. Termination

Ending the relationship

By You

You may terminate your account at any time through the Settings page. Upon termination, your subscription will end, and your data will be permanently deleted within 30 days (subject to legal retention requirements).

By Us

We may suspend or terminate your access to the Service if:

• You violate these Terms or the Acceptable Use Policy
• Your use of the Service poses a security risk
• We are required to do so by law or regulatory order
• Your account has been inactive for more than 12 months (Free tier only)

We will provide 30 days' notice before termination when reasonably possible, except in cases of Terms violations or security threats, where immediate action may be necessary.

13. Dispute Resolution

How disagreements are handled

Informal Resolution: Before filing any formal claim, you agree to first contact us at legal@mylegacyconsole.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: If informal resolution fails, any disputes will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be conducted in the State of New York, and the arbitrator's decision will be final and binding.

Class Action Waiver: You agree that any dispute resolution will be conducted on an individual basis and not as part of a class, consolidated, or representative action.

Small Claims Exception: Either party may bring individual claims in small claims court if the claims qualify.

14. General Provisions

Standard legal terms

• Governing Law: These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Montauk Trading Company, LLC regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
• Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights at any time.
• Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, wars, epidemics, government actions, or infrastructure failures.
